1. Acceptance of these terms

These Terms and Conditions govern your access to and use of the website at www.credif.in and Credifin’s related digital channels (together, the “Website”), operated by Credifin Limited (formerly PHF Leasing Limited), a Non-Banking Financial Company registered with the Reserve Bank of India under Certificate of Registration No. B-06.00124 (Section 45-IA of the Reserve Bank of India Act, 1934), CIN L65110PB1992PLC012488.

By accessing, browsing or submitting information through the Website, you confirm that you have read, understood and agree to be bound by these terms. If you do not agree, please do not use the Website.

These terms govern use of the Website. They do not replace, vary or override the terms of any loan agreement, sanction letter, Key Fact Statement or other document you sign with Credifin. In case of conflict, those documents and applicable RBI directions prevail.

2. Definitions

• Company / we / us — Credifin Limited (formerly PHF Leasing Limited), an RBI-registered NBFC.
• You / user — Any person accessing or using the Website, whether or not you apply for a product.
• Services — Information, calculators, enquiry and application facilities and related features made available on the Website.
• Application — An enquiry or request for a loan or other product submitted through the Website or a channel partner.
• Content — All text, images, graphics, logos, data, design, code and other material on the Website.

3. Who may use the Website

• You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872
• You must be a resident of India, unless we expressly offer a product to non-residents
• You must not be barred from receiving services under Indian law, or be on any sanctions or prohibited list
• If you use the Website on behalf of an entity, you confirm you are authorised to bind that entity

4. The Website is information, not an offer

This is the most important clause on this page, so it is stated plainly.

Nothing on the Website constitutes an offer, invitation, commitment or promise to lend. Information about products, interest rates, loan amounts, tenures, eligibility and charges is indicative and provided for general guidance only. It does not create any right in your favour or any obligation on Credifin.

• All loans are granted at the sole discretion of the Company
• Sanction is subject to eligibility, credit assessment, verification, documentation and the Company’s applicable credit policy
• The Company may decline any application without assigning a reason, to the extent permitted by law
• Applicable interest rate, loan amount, financing percentage, tenure, fees and charges are determined for each applicant individually and are communicated in the sanction letter and Key Fact Statement
• Any indicative interest-rate range shown on the Website is a range, not a quoted or guaranteed rate

5. Interest rates, charges and advertised figures

Any interest rate, rate range, fee, charge, loan amount, tenure, financing percentage or saving referred to on the Website, in an advertisement, on a hoarding, in a brochure, on social media, in a dealer display or in any campaign material is indicative and illustrative only.

A figure such as “12% p.a.” or an indicative band such as “12%–24% p.a.” is not a quoted rate, not an offer, and not a commitment. It describes a range within which rates have been or may be offered. It creates no entitlement to that rate and no obligation on the Company to grant it to you or to anyone.

• The rate applicable to you is determined individually, at the sole discretion of the Company, after credit assessment of your specific profile
• Two applicants borrowing similar amounts may be offered materially different rates, tenures and terms
• Rates, fees and charges are subject to change without prior notice, and the rate prevailing on the date of sanction applies
• The lowest figure in any published range is available only to applicants meeting the Company’s criteria for it, and may not be available at all in a given period
• Processing fees, documentation charges, stamp duty, insurance, prepayment and foreclosure charges, bounce charges, penal charges and applicable taxes are payable in addition, as set out in the applicable schedule of charges
• Any figure appearing in an EMI calculator, comparison, illustration or example is arithmetic on the values entered and is not a quotation

The binding commercial terms of your loan are only those set out in the sanction letter, Key Fact Statement and loan agreement executed between you and the Company. Where any published, advertised or verbally communicated figure differs from those documents, those documents prevail.

Typographical errors, pricing errors and inadvertent misstatements on the Website or in campaign material do not bind the Company, and may be corrected at any time without liability.

6. Offers, campaigns, promotions and prize draws

The Company runs promotional offers, campaigns, product schemes and periodic prize draws from time to time, including in association with dealers, manufacturers and channel partners. The following applies to all of them, in addition to any specific terms published for that offer.

General

• Every offer is subject to eligibility, availability and the applicable terms of that offer, and is valid only for the period and territory stated
• The Company may vary, suspend, extend, shorten or withdraw any offer at any time without prior notice and without assigning a reason
• Offers cannot be combined with any other offer or discount unless the Company expressly notifies otherwise in advance
• Offers are non-transferable and carry no cash value unless expressly stated
• Participation in an offer does not entitle you to a loan, and does not affect the Company’s discretion in assessing your application
• The Company’s decision on eligibility, interpretation and fulfilment of any offer is final and binding

Assured benefits, accessories and gifts

• Any “assured” benefit, accessory, kit or gift is provided subject to availability and at the sole discretion of the Company
• The Company may substitute any item with one of comparable value based on stock levels, supply or other considerations
• Stated values of accessories or gifts are indicative retail values and are not redeemable for cash
• Warranty, servicing and after-sales support for any accessory or vehicle rests with its manufacturer or dealer, not with the Company

Prize draws and winner selection

• Where an offer includes a draw, selection is made in the manner and at the frequency determined by the Company, and the Company’s selection is final and binding
• No correspondence or challenge regarding selection will be entertained
• Participation does not guarantee a prize; the number of prizes is limited to that stated
• Winners may be required to furnish identity, KYC and other documents before a prize is released, and to sign a receipt and release
• All taxes, including tax deducted at source under the Income-tax Act, 1961, and any other duty, levy or expense on a prize are the responsibility of the winner
• The Company may publish a winner’s name, city and photograph for announcement and publicity purposes, and by participating you consent to this
• Employees of the Company, its group entities, and their immediate families may be excluded from participation
• The Company may disqualify any participant and cancel any benefit obtained through fraud, misrepresentation, manipulation or breach of these terms

Nothing in any offer, campaign or draw is intended to constitute a lottery, wagering contract or prize competition prohibited under applicable law. Offers are void where prohibited or restricted by law, and are not open to residents of any state or territory where they would be unlawful.

Third-party and dealer offers

Where an offer is made by a dealer, manufacturer, insurer or other third party, that party is solely responsible for it. The Company merely facilitates financing and accepts no liability for the availability, quality, delivery or honouring of a third-party offer, or for any representation made by a dealer or its staff that is not confirmed in writing by the Company.

7. Calculators and illustrations

EMI calculators, eligibility indicators and similar tools on the Website are provided for illustration. Outputs are estimates generated from the values you enter, do not account for all fees, taxes, charges or the rate actually applicable to you, and must not be relied on as a quotation. Your actual EMI and total cost of borrowing will be set out in your loan documents.

8. Your obligations

• Provide information and documents that are true, accurate, current and complete, and update them if they change
• Do not impersonate any person or misrepresent your association with any person or entity
• Do not submit an application on behalf of another person without their authority
• Keep any credentials issued to you confidential and notify us immediately of suspected misuse
• Use the Website only for lawful purposes and in accordance with these terms

Submitting false or misleading information may result in rejection of your application, recall of a sanctioned facility, reporting to Credit Information Companies and authorities, and action under applicable law.

9. Fraud warning

Fraudsters impersonate lenders. Please read this clause even if you read nothing else.

Credifin never asks for an advance fee, processing payment, “file charge”, security deposit or gift card to release or approve a loan. We never ask for your OTP, UPI PIN, card CVV, internet-banking password or account password. No employee or representative is authorised to request them.

• Payments to Credifin are made only to Company bank accounts notified in your loan documents — never to a personal account
• Verify any communication claiming to be from Credifin by calling 079651-74500 or writing to info@credif.in before acting on it
• Our official website is www.credif.in — check the address carefully, as look-alike domains are used in fraud
• Report suspected fraud to us immediately, and to the national cyber-crime portal at cybercrime.gov.in or helpline 1930
• Credifin does not accept public deposits. Our RBI Certificate of Registration is expressly marked “Not valid for accepting Public Deposits”. Anyone inviting you to place a deposit, investment or fixed return with Credifin is acting fraudulently — report it immediately

The Company accepts no liability for loss arising from dealings with any person or platform not authorised by it.

10. Contacting you

When you submit an enquiry or application, you authorise Credifin, its employees, agents and authorised channel partners to contact you by telephone, SMS, email, WhatsApp and other channels in relation to that enquiry and to your loan account.

This consent overrides any registration you hold under the DND / NCPR registry for the limited purpose of servicing your enquiry and account. You may opt out of promotional communication at any time by writing to info@credif.in; transactional and statutory communication about your account will continue, because we are required to send it.

11. Intellectual property

All Content on the Website, including the Credifin name, logo, marks, design, layout, text, graphics and underlying code, is owned by or licensed to the Company and is protected by Indian and international intellectual property law.

• You may view and print Content for your own personal, non-commercial reference
• You may not copy, reproduce, republish, distribute, modify, translate, frame, scrape, mine or create derivative works from the Content without our prior written consent
• You may not use our name, logo or marks in any manner that suggests association, endorsement or sponsorship without written permission
• Automated extraction — including scraping, crawling beyond robots.txt, or bulk downloading — is prohibited

12. Third-party links and content

The Website may link to third-party websites, including dealer partners, campaign pages, payment providers and government portals. Those sites are not controlled by us. We provide the links for convenience, do not endorse their content, and are not responsible for their availability, accuracy, products, security or privacy practices. Your use of them is governed by their own terms.

13. Prohibited use

You must not:

• Interfere with, disrupt or attempt to gain unauthorised access to the Website, its servers or connected networks
• Introduce any virus, worm, malicious code or other harmful material
• Use any robot, spider, scraper or automated means to access the Website except as permitted by robots.txt
• Probe, scan or test the vulnerability of the Website, or breach its security or authentication measures
• Use the Website in any way that is unlawful, fraudulent, defamatory, or that infringes the rights of others
• Reverse engineer, decompile or disassemble any part of the Website

14. Availability and changes

We aim to keep the Website available but do not guarantee uninterrupted or error-free access. We may modify, suspend or discontinue any part of the Website, or any product or feature described on it, at any time and without notice. We may also update these terms; the revised version takes effect when published on this page, and continued use constitutes acceptance.

15. Disclaimer of warranties

The Website and its Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, currency and non-infringement.

While we take reasonable care, we do not warrant that the Content is free from error or omission, that the Website is free from viruses, or that defects will be corrected. Nothing on the Website constitutes financial, legal, tax or investment advice; you should obtain independent professional advice before making a decision.

16. Limitation of liability

To the fullest extent permitted by applicable law, the Company, its directors, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for any loss of profit, revenue, business, goodwill, data or anticipated savings, arising out of or in connection with your use of, or inability to use, the Website — whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such loss.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable Indian law, including liability for fraud.

17. Indemnity

You agree to indemnify and hold harmless the Company, its directors, officers, employees and agents from and against any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the Website, your violation of any law, or your infringement of any third-party right.

18. Privacy

Your personal data is handled in accordance with our Privacy Policy, which explains what we collect, why, who we share it with, how long we keep it, your rights under the Digital Personal Data Protection Act, 2023, and how to raise a grievance. Please read it alongside these terms.

19. Force majeure

The Company shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including act of God, flood, fire, earthquake, epidemic or pandemic, war, civil unrest, terrorism, strike, failure of telecommunications or power, cyber-attack, or any change in law or direction of a governmental or regulatory authority.

20. EV Boarding Pass — product terms

The following terms apply specifically to the Credifin EV Boarding Pass, in addition to the rest of this page. Where they conflict with the general terms above, these specific terms prevail for the Boarding Pass only.

• The Boarding Pass is digital in nature; the physical boarding pass is a hard copy only.
• Validity — this EV Boarding Pass is valid for one year (12 months) from the date of issuance and may be extended at the discretion of the Company.
• Non-refundable — this EV Boarding Pass cannot be returned or exchanged for cash.
• Ownership — ownership of this Pass is not restricted to the purchaser and may be transferred to another person after purchase.
• Exclusion — this Boarding Pass cannot be used in conjunction with any other promotional offer or discount; if any promotion is applicable, it will be notified by the Company in advance.
• Cancellation (fraud) — Credifin Limited reserves the right to cancel any EV Boarding Pass obtained fraudulently.
• Governing law and jurisdiction — these Boarding Pass terms are governed by and construed in accordance with the laws of India. You agree to submit to the exclusive jurisdiction of the courts at Jalandhar in case of any dispute. You agree to indemnify Credifin Limited for all claims brought by any third party against it or its affiliates arising out of or in connection with any breach of these EV Boarding Pass terms and conditions.
• Modification of terms — we reserve the right to alter these terms and conditions, with information available on the bar code available on the EV Boarding Pass.
• Non-redeemable for cash — this EV Boarding Pass has no cash value and cannot be exchanged for cash or credit, in part or in whole.
• Cancellation (misuse) — we reserve the right to cancel this Boarding Pass for any misuse or violation of terms.
• Exclusivity — the customer must present the original pass or digital pass in order to claim the associated benefits.
• Accessories — the Company will provide accessories subject to availability and at its sole discretion. The Company reserves the right to substitute or alter the accessory provided based on stock levels or other considerations.
• Company discretion — the brands of Electric Vehicles (EVs) are not fixed and will be determined at the sole discretion of the Company. The Company reserves the right to change or select brands based on availability, partnership or other factors.

The Boarding Pass is a promotional product. It is not a loan, a loan sanction, a guarantee of finance, an insurance product or a security, and holding one does not entitle the holder to credit on any particular terms. Any loan remains subject to eligibility, credit assessment and the Company’s applicable policy.

21. Grievance redressal

If you have a complaint about the Website, a product or our service, please use this route. Each level has a defined response window; escalate if you are not satisfied.

22. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of India. Subject to any arbitration or dispute-resolution clause in your loan documents, the courts at Jalandhar, Punjab shall have exclusive jurisdiction over any dispute arising out of or in connection with these terms or your use of the Website.

If any provision of these terms is held invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force. A failure to enforce any provision is not a waiver of it.
